Summary
In certain specific cases, an individual exemption regarding family allowances may grant or maintain entitlement to family allowances. It applies outside the usual rules if the child’s situation is socially significant.
This may apply, in particular, in situations such as:
- a stay abroad by a young job seeker with the approval of the ONEM;
- studying abroad;
- a birth abroad with a child’s late registration in the population registry of a Walloon municipality (more than two months after birth);
- the designation of a beneficiary in complex cases, such as surrogacy.
AVIQ reviews each application individually.
Key points
- The application must be submitted to AVIQ – Exceptions Department;
- The request must be supported by a statement of reasons and accompanied by supporting documentation demonstrating the social significance of the situation;
- AVIQ may grant the exemption, without any obligation to do so, even if the conditions are met.
For further information, please contact your family allowance fund directly.
In detail
- Parents of children under 25 years of age
- Children receiving family allowances
Each application is reviewed on a case-by-case basis by AVIQ, taking into account the best interests of the child.
The exemption makes it possible to establish or maintain eligibility for family allowances in situations that meet the conditions set forth in the law.
The amount of family allowances is determined according to the usual rules, based on the child’s situation, birth order, the parents’ status, or any applicable social supplements.
To apply for an individual exemption, the family must complete a specific form and send it to AVIQ:
- by mail, addressed to the Exemptions Department;
- by email to the following address:
derogations@aviq.be .
The request must be accompanied by the properly completed form.
Depending on the situation, AVIQ may request additional information, such as:
- a school form;
- approval from the ONEM;
- any other relevant supporting documentation.
An official letter announcing the decision to grant or deny the exemption is always sent to the family and the family allowance fund to inform them.
